Terms of Service
1. Introduction
These Terms and Conditions apply to all services provided by Jürgen’s Photography. By booking a session, you agree to be bound by these terms.
2. Booking and Deposit
2.1. To confirm your booking, a non-refundable deposit of 50% of the total session fee is required. This deposit secures your session date and time.
2.2. The remaining balance is due on the day of the shoot, prior to the commencement of the session.
3. Payment
3.1. Payments can be made via bank transfer, cash, or any other method agreed upon at the time of booking.
3.2. Failure to pay the remaining balance on the day of the shoot may result in the cancellation of the session and forfeiture of the deposit.
4. Cancellation and Rescheduling
4.1. Cancellations made more than 48 hours prior to the scheduled session will receive a full refund of any payments made, excluding the non-refundable deposit.
4.2. Cancellations made less than 48 hours prior to the session will not receive a refund.
4.3. Rescheduling requests must be made at least 48 hours prior to the session and will be accommodated subject to availability.
5. Session Policies
5.1. Clients are expected to arrive on time for their scheduled session. Late arrivals may result in a shortened session or rescheduling at the photographer’s discretion.
5.2. The client is responsible for their own attire, makeup, and any other preparation required for the session.
6. Image Delivery and Usage
6.1. Jürgen’s Photography will provide high-resolution edited images within 2-3 weeks after the session.
6.2. The client may use the images for personal or business purposes, but may not sell or distribute the images without prior consent from Jürgen’s Photography.
6.3. Jürgen’s Photography reserves the right to use any images from the session for promotional purposes, unless otherwise agreed in writing.
7. Liability
7.1. Jürgen’s Photography is not liable for any injuries, losses, or damages that occur during the session.
7.2. In the event of equipment failure or other unforeseen circumstances that prevent the session from being completed, the client will be offered a rescheduled session or a full refund.
8. Privacy and POPIA Compliance
8.1. Jürgen’s Photography respects your privacy and complies with the Protection of Personal Information Act (POPIA) of South Africa.
8.2. Personal information collected from clients will be used solely for the purpose of providing photographic services and will not be shared with any third parties without your explicit consent, unless required by law.
8.3. By booking a session, you consent to the collection, storage, and processing of your personal information by Jürgen’s Photography in accordance with POPIA.
8.4. Clients have the right to access, correct, or delete their personal information held by Jürgen’s Photography. Requests can be made in writing to Jürgen Hansmann, 4 Dawlish Road, Plumstead, Cape Town, 7801, or via email at jurgen@jurgen.co.za.
8.5. Jürgen’s Photography will take all reasonable steps to protect personal information from loss, damage, unauthorized access, or disclosure.
9. Agreement
By booking a session with Jürgen’s Photography, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
